Terms of Use
1. These terms
These terms apply to your use of ubernatural.io (the "site"), operated by Advanced Design Technologies Ltd ("ubernatural", "we", "us"). By using the site, you accept them. If you don't, please don't use the site.
They cover the site only. Our design and development services are governed by the proposal, statement of work or contract we sign with each client, which prevails over these terms.
2. No offer, no contract
Case studies, service descriptions and everything else on the site are for information. They are not an offer. Sending an enquiry or a brief doesn't create a contract or commit either of us to anything. A project starts only when we both sign an agreement.
3. Enquiries, briefs and materials
Accuracy. Please give us accurate information. If you send an enquiry on behalf of a company, you confirm you're authorised to do so.
Your materials. You keep all rights in the files, links and information you send us, and you confirm you have the right to share them. You give us a non-exclusive, royalty-free licence to use, copy and store them only to assess your enquiry and prepare a proposal. The licence ends when we delete them.
Confidentiality. We treat non-public information in your brief, such as revenue, funding stage and product plans, as confidential. We use it only to assess your enquiry and prepare a proposal, and share it only with team members and contractors who need it and are bound by confidentiality. This doesn't apply to information that is public, that we already knew, that we develop independently, or that we lawfully receive from someone else. If you'd like a signed NDA before sharing details, just ask.
Similar work. We work with many clients, some in the same industries. Receiving your enquiry doesn't stop us from working on similar ideas or styles, or with your competitors, as long as we don't use your confidential information.
4. Our content
The site and its content, including design, code, animation, text, images, video and the ubernatural name and logo, belong to us or our licensors and are protected by intellectual property laws.
You may view the site, share links to it and quote short extracts with attribution. Otherwise, you may not copy, reproduce, frame, distribute, modify or create works based on the site or its content, or reverse-engineer its code or animations, except as the law expressly allows.
5. Client work and trade marks
Client projects appear with our clients' permission. Client names, logos and trade marks belong to their owners. They identify who we've worked with and don't mean that those clients endorse this site or anything else.
If you hold rights in something on the site and believe it shouldn't be here, email bogdan@ubernatural.io with the details and we'll review it promptly.
6. AI-generated content
Some images and video on the site, including in our showreel and case studies, are created or modified with AI tools as part of our creative work. Some of this content shows realistic people, places or scenes that don't exist. We label AI-generated content where it appears.
If you believe content on the site uses your likeness without permission, email bogdan@ubernatural.io and we'll review it promptly.
7. Text and data mining
We reserve all rights in the site's content against text and data mining, including for training AI models, within the meaning of Article 4(3) of Directive (EU) 2019/790 and equivalent laws, except where the law allows such use without our permission. This reservation is also expressed in machine-readable form on the site.
8. Acceptable use
When using the site, you must not:
- disrupt, overload or try to gain unauthorised access to the site or its systems;
- probe or test its security without our written permission;
- scrape or harvest content or data by automated means, except for search engine indexing;
- upload malware or other harmful code;
- send spam or automated submissions through our forms;
- impersonate anyone or give false information;
- use the site for anything unlawful.
9. Blog and case studies
Our blog and case studies are general information, not professional, legal, financial or technical advice. Results we describe, such as views, leads or revenue, come from specific past projects and aren't a promise of what we'll achieve for you.
10. Interactive features
The button playground in our footer changes how buttons look for you during your visit. Your choice stays in your browser and isn't sent to us.
11. Links to other sites
The site links to third-party sites, such as our social media profiles. We don't control them and aren't responsible for their content or practices.
12. Availability
We may change, suspend or remove any part of the site at any time. We don't guarantee that it will always be available or free of errors.
13. Disclaimer
To the extent the law allows, the site is provided "as is" and "as available", without warranties of any kind, express or implied.
14. Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data or business opportunity, arising from your use of the site. Our total liability for any claim relating to the site is limited to USD 100.
Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that can't be limited by law, including your non-excludable rights under consumer laws such as the Australian Consumer Law. This section doesn't apply to our services, which are governed by the relevant client agreement.
15. Governing law and courts
These terms are governed by the laws of the Dubai International Financial Centre. The DIFC Courts have exclusive jurisdiction over any dispute arising from them. If you're a consumer, you keep any mandatory protections of the law where you live and may be able to bring proceedings in your local courts.
16. Language
These terms are written in English. If we provide a translation, the English version prevails.
17. Changes
We may update these terms. The effective date at the top shows the current version. By continuing to use the site after a change, you accept the updated terms.
